Introduction
These Terms of Service (“Agreement”) govern the provision of managed hosting and WordPress-related services (“Services”) provided by Western Mass Hosting (“Provider”, “we”, “us”) to the client (“Client”, “you”). By engaging our Services, you agree to be bound by these Terms.
Service Offerings
Managed Hosting Services
Our managed hosting solution provides secure, optimized infrastructure on AWS Lightsail, including: server provisioning, security hardening, resource monitoring, and automated backups. We maintain network availability and perform essential maintenance to ensure optimal hosting performance.
WordPress Maintenance Services
For clients electing WordPress maintenance, we provide:
- Scheduled core, plugin, and theme updates with pre-update compatibility testing
- Security patching and vulnerability monitoring
- Uptime monitoring with emergency response
- Extended offsite backups
This service requires all components to be properly licensed and excludes custom-coded solutions not available through official repositories.
Web Development Services
Custom development work including web design, custom CMS, WordPress theme/plugin customization, migrations, and performance optimization requires a separate Statement of Work. All deliverables remain Client property upon full payment, while Provider retains rights to reusable code components.
Client Obligations
You warrant that all content complies with applicable laws and third-party licenses. You must maintain valid licenses for all software components and promptly provide access credentials for maintenance purposes. Any interference with our management protocols, including manual updates during maintenance windows, voids performance guarantees.
Payment Terms
Fees are payable in advance per the executed service agreement. Managed hosting commitments require 30-day written notice for cancellation, with no prorated refunds. Annual and quarterly contracts require payment of the full term if terminated early. WordPress maintenance and development services are billed separately from hosting fees.
Termination
Either party may terminate for material breach with 30-day cure notice, except for payment defaults or security incidents warranting immediate suspension. Upon termination, we will provide a 30-day window to retrieve data from our backup systems before permanent deletion.
Data Protection
Backup Policy
Automated backups are retained for 14 calendar days. Clients are responsible for maintaining their own archival copies. Backup restoration requests may incur professional service fees.
GDPR Compliance
Where processing EU personal data, we act as Data Processor under Article 28 GDPR. Our subprocessor (AWS) maintains SOC 2 and ISO 27001 compliance. Data subject requests should be forwarded to our Data Protection Officer at info@westernmasshosting.com. We implement appropriate technical measures including encryption and access controls, and will notify you of any breaches impacting your data within 72 hours of confirmation.
Limitations of Liability
Our aggregate liability is limited to fees paid during the 12 months preceding the claim. We exclude liability for: (i) third-party service failures; (ii) damages arising from Client’s failure to implement recommended security measures; or (iii) data loss occurring more than 30 days post-termination.
General Provisions
This Agreement constitutes the entire understanding between parties and supersedes all prior agreements. Amendments require written consent. The Agreement shall be governed by the laws of the Commonwealth of Massachusetts, with exclusive venue in Hampden County.
